I have been following a story since August about rumors flourishing around Obama's status of citizenship of the United States. I thought of it being a joke, but I was reading to damning evidence that Barack Obama may not be a citizen of the United States.
There is a Pennsylvania attorney Philip J. Berg, who filed a lawsuit demanding Sen. Barack Obama present proof of his American citizenship. Before you say that he is a Republican hack, Berg is a prominent laywer and a former Deputy Attorney General of Pennsylvania, who is also a die-hard Democrat.
Phillip Berg filed suit in U.S. District Court in August, alleging that Obama is not a natural-born citizen and is thus ineligible to serve as president of the United States. The lawsuit is simple. Obama has to answer to the charges and dispute them, or base on legal procedures, he defaults and accepts the accusation.
This is called Rule 36 of the Federal Rules of Civil Procedure, which states that unless the accused party provides written answer or objection to charges within 30 days, the accused legally admits the matter.
Therefore, if Obama doesn't respond in 30 days, which was October 15, 2008, he legally admitted to the lawsuit's accusations, including the charge that the Democratic presidential candidate was born in Mombosa, Kenya, registering in the state of Hawaii four days after his birth, lying about his place of birth, faking his birth certificate, fraudulently running for office and accusing the DNC for not properly vetting its candidate.
Wouldn't it be easy to produce a birth certificate? Even though Obama has posted an image of a Hawaii birth certificate online, I really question of its authenticity. It looks fake to me. What Berg is asking is that the court verify the birth certificate, which the Obama campaign has not provided.
The only peep from Obama came with a filed motions to dismiss, but he has not actually answered the charges in the lawsuit. According to the Rule 36, Obama has legally admitted he is not a natural-born citizen.
Berg is a smart cookie. He was able to cover all base to prevent his lawsuit from falling apart. Berg filed a Requests for Admissions on Sept. 15, 2008, meaning Obama had until Oct. 15 to answer or accept the consequences of Rule 36.
And since the deadline has past, Berg made a public statement. He said, "Obama and the DNC admitted, by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit. Obama is not qualified to be president and therefore Obama must immediately withdraw his candidacy for president and the DNC shall substitute a qualified candidate."
Recently, Berg filed two additional motions at the district court in Philadelphia. The first asks the court to notify Obama and the DNC that they have now legally admitted to the charges, and the second asks for an expedited ruling before the Nov. 4 election.
Base on "Fight the Smears" section of Obama's website, it states:
"Smears claiming Barack Obama doesn't have a birth certificate aren't actually about that piece of paper. They're about manipulating people into thinking Barack is not an American citizen. The truth is, Barack Obama was born in the state of Hawaii in 1961, a native citizen of the United States of America." The website provides an images of a Hawaii birth certificate bearing the name Barack Hussein Obama II, which is highly questionable.
The irony about this is based on the fact that no media outlet nor the Obama machine are willing to challenge Berg's accusations. That itself gives merit that Obama doesn't want this to become an issue just weeks before the general election.
By not voicing the lawsuit, Obama has admitted to everything. Therefore, Obama admits he was born in Kenya. Obama admits he was adopted in Indonesia. The birth certificate posted online is a phony. And he admits that he is constitutionally ineligible to run for president of the United States.
I wonder if this is the October surprise that Obama was concerned about.
